Terms and Conditions

These Terms and Conditions (“Terms”) set out the rules governing access to and use of the website https://wonderimage.art (the “Service” or “Platform”). The Platform is operated by LOGOMA s.r.o. based in Podskalská 1512/22, Nové Město, 128 00, Praha 2, Czech Republic.
By creating an account, adding funds, or requesting AI-generated content, you confirm that you have read and agreed to these Terms. If you do not accept them, you must discontinue use of the Platform.
1. Nature of the Platform
Wonderimage.art provides an automated digital service that converts user-submitted descriptions into computer-generated images using artificial intelligence technology.
The Service includes:
• submission of text prompts and creative parameters
• automated generation of digital images
• downloadable output files in supported formats
• a personal user account environment
• prepaid internal Balance used to purchase generation requests
The Platform does not provide design consulting, professional artistic services, or human-created artwork.
2. Age Requirements and Legal Capacity
Use of the Platform is permitted only to individuals aged 16 years or older.
If you are under 18, you confirm that you are using the Service with permission from a parent or legal guardian.
By using the Platform, you represent that you are legally capable of entering into a binding agreement under applicable law.
3. User Profile and Access Credentials
Access to certain features requires account registration.
You agree to:
• provide accurate registration information
• maintain confidentiality of your login credentials
• promptly notify us of unauthorised use
We reserve the right to suspend access where account activity appears unsafe, unlawful, or inconsistent with these Terms.
4. Internal Balance System
The Platform uses an internal prepaid balance (“Balance”) to enable purchases of generation services.
Key characteristics:
• Balance may be increased by payments through supported methods
• minimum deposit: €5
• maximum deposit: €3000 per transaction
• Balance represents prepaid service credit only
• Balance cannot be transferred to third parties or redeemed for cash
• no interest or financial return accrues
Payments are handled by independent payment processors. The Company does not store full payment card information.
Transaction confirmations or invoices may be issued electronically following successful payment.
Any refund of unused Balance (where legally required) is processed as a reversal or refund to the original payment method where technically supported and does not constitute a cash-out, money transfer, or cash redemption service.
5. Service Requests and Pricing
Users may submit requests for AI-generated images through available request types.
Pricing depends on the selected request configuration and is displayed before confirmation.
A request is considered fulfilled once the generated output becomes accessible to the user for download within the Platform. Fulfilment occurs when the output is made available in your account for download.
We may modify pricing, features, or request parameters at any time. Changes will not affect requests already confirmed and paid for.
6. Digital Service Performance and Refund Conditions
The Service consists of immediately delivered digital content created at the user’s instruction.
Therefore:
• once a generation process has started, the service is deemed performed
• completed requests are not refundable
• Balance used for completed requests cannot be restored
Where consumer law requires, unused prepaid Balance may be refunded subject to verification and applicable payment method limitations.
By initiating a request, you expressly consent to immediate performance of the digital service. You acknowledge that, where a statutory right of withdrawal applies, it may be lost once performance begins.
7. Artificial Intelligence Output Disclaimer
Images generated through the Platform are produced automatically by machine learning systems.
The Company does not guarantee that outputs will:
• meet user expectations
• be accurate or technically correct
• be original or exclusive
• be free from similarities to other works
• be suitable for any particular purpose
Variations in quality, composition, or interpretation are inherent characteristics of AI-generated content.
8. Responsibility for Prompts and Content Use
You are fully responsible for the text prompts and parameters you submit.
You agree not to request content that:
• infringes intellectual property rights
• violates privacy or personality rights
• contains unlawful or harmful material
• breaches applicable laws
The Company does not review prompts before processing. However, we may review prompts and/or generated outputs after processing to detect misuse, enforce these Terms, comply with legal obligations, or respond to user support requests. Where we identify suspected violations or unlawful content, we may remove outputs, restrict access, or suspend accounts.
9. Rights in Generated Materials
Subject to compliance with these Terms, we grant you a non-exclusive, worldwide, royalty-free licence for as long as you comply with these Terms to use, reproduce, modify, create derivative works from, and display the generated images for lawful personal or commercial purposes. This licence does not transfer ownership of the Platform, underlying AI models, or any Company or third-party technology. We do not guarantee that a specific output does not infringe third-party rights, and you remain responsible for ensuring lawful use of outputs in your intended context. If you breach these Terms, we may suspend or terminate your access to the Platform and restrict further access to generated outputs through the Platform and your account to the extent permitted by law.
10. Acceptable Use Standards
You must not:
• attempt to disrupt or overload the Platform
• access systems without authorisation
• use automated extraction tools
• exploit technical vulnerabilities
• engage in fraudulent activity
Violations may result in temporary or permanent account restrictions.
11. Monitoring and Fraud Prevention
To maintain service integrity and legal compliance, we may analyse usage patterns, transactions, and account behaviour.
Where necessary, we may request identity verification or suspend activity pending review.
12. Availability and Technical Limitations
The Platform is provided on an “as available” basis.
We do not guarantee uninterrupted operation or error-free functionality.
Temporary interruptions may occur due to maintenance, updates, or external provider failures.
13. Limitation of Liability
To the extent permitted by law, the Company shall not be responsible for:
• indirect or consequential damages
• loss of revenue or business opportunities
• dissatisfaction with generated outputs
• technical incompatibility or user errors
Total liability arising from the use of the Platform shall not exceed the amount paid by the user during the preceding twelve months.
Nothing in these Terms excludes liability where prohibited by applicable law.
14. Account Suspension or Termination
We may restrict or terminate access where:
• Terms are breached
• fraudulent behaviour is detected
• legal compliance requires action
• security risks arise
Termination may result in loss of access to the account environment, subject to legal obligations regarding prepaid funds.
15. Amendments
We may revise these Terms periodically to reflect operational or legal developments.
The updated version will be published with a new revision date.
Continued use of the Platform after publication constitutes acceptance.
16. Governing Law
These Terms are governed by the laws of the Czech Republic together with applicable European Union legislation.
Consumers may rely on mandatory protections available in their country of residence.
